Dear Friends,
On behalf of CWIN, Alliance Nepal, my family
and myself I thank you all for your unprecedented solidarity,
concerns and the efforts you have made to put pressure on
the government of Nepal for my unconditional release. The
petitions and appeals you had sent played significant role
in my release.
On February 28, 2005, after a day long hearing
on my habeas corpus writ, the division bench of Honourable
Judges Mr. Arjun Prasad Singh and Mr. Anup Raj Sharma made
a decision stating that my detention was illegal and that
I be released right from the court premises. But soon after
my release, I was arrested again by the police just few yards
away from the Supreme Court premises. After a while the police
received a message in their information set and only then
I was taken home by the same police van.
I feel that my arrest was an example of
inferiority complex of the government from Human Rights Community
and it proves that Human Rights community is targeted because
they have a very strong presence and voice in Nepal. Since
I was arrested on February 17, 2005 at the Tribhuvan International
Airport in my way back from Europe after attending international
conference on the Rights of children and was away from Nepal
during this dramatic political change, I was arrested for
the baseless reason.
The decision made by the Honorable Court
reinstates our belief in Democracy and Human Rights. The decision
has become a landmark one as it was a first ever hearing in
response to the writ petition under Habeas Corpus after the
declaration of the state of emergency on 1st February 2005.
Hence I consider it as a victory of entire Human Rights community
of Nepal.
Human Rights of community of the world,
UN High Commissioner's Office of Human Rights, Global March
against Child Labour, Educational International, UN agencies,
Diplomatic Community, Partners and Friends of CWIN in different
countries, Nepal Bar Association, NGOs and Human Rights Community
and Journalists of Nepal have greatly demonstrated their support,
solidarity and concerns in my release. I am truly grateful
to all of them. I am also thankful to the Honorable Supreme
Court of Nepal, Honorable Judges and Lawyers of Nepal Bar
Association for their strong support.
You all know we are yet again fighting the
battle for the restoration of Human Rights, democracy and
peace in Nepal. I sincerely believe that Nepali people and
Human Rights community in Nepal will continue to receive your
support and solidarity in resolving the present crisis of
Nepal in a peaceful and democratic way.
In this present situation, children are
the most vulnerable group in the society, caught in between
the ongoing armed conflict. The state of Rights of the children
is deteriorating day by day, depriving them of fundamental
Rights of education, protection and even survival; let the
development be far away. So, in this moment of chaos for the
children and child Rights activist, I call upon all the national
and international Human Rights community to express their
solidarity in our movement for children's rights. We need
to ensure that none of the children are deprived of their
Rights- their right to live, learn and to be a productive
youth of future who would value the freedom and the democracy
and will bring new dawn in the nation and the world.
